Sega faces unfair labor practice complaint for planned mass layoff of union members

Workers at Sega of America are accusing the video game company of "bad faith bargaining with workers" for its plan to lay off dozens of temporary workers. The publisher known for franchises that include Sonic the Hedgehog and Yakuza is now facing an unfair labor practice complaint filed by the Communications Workers of America (CWA). In April, 200 people in various departments across the company overwhelmingly voted in favor of unionization and formed the Allied Employees Guild Improving Sega (AEGIS-CWA) under the CWA. Now, Sega allegedly intends to lay off 80 of those unionized workers.

In its complaint, the CWA explained that it's been in bargaining with Sega since September. On November 6, Sega apparently presented the organization with a proposal to phase out of all its temporary employees by taking their work offshore to the company's offices in Europe and Japan by February 2024. Those temporary employees make up 40 percent of the union's bargaining unit and mostly work in quality assurance and localization, which the group describes as "critical to Sega's success."

The afternoon after their meeting, the CWA said Sega presented its proposal to the affected employees through captive audience meetings. "We believe this is a clear case of bad faith bargaining," the CWA wrote in its complaint, since Sega dealt directly with the union members and "violated status quo" by telling them they're losing their jobs. 

"Sega will not be allowed to get away with this unlawful behavior," Elise Willacker, Senior QA Tester Temp, said in a statement. "We call on the company to make all temporary employees permanent and return to the bargaining table in good faith. There is no other just alternative." As Kotaku notes, the organization's complaint is now in the hands of the National Labor Relations Board, but it may take a while to resolve and may not prevent the layoffs from taking place.

Ford reaches a tentative agreement with striking auto workers

Ford has called its 20,000 employees back to work now that it has reached a tentative agreement with the United Auto Workers (UAW). The two parties have agreed on a new four-year labor contract that include a 25 percent pay increase for employees over that period, according to Reuters and The New York Times. With the cost-of-living wage adjustments the union has also successfully negotiated, the total pay hikes would amount to 33 percent, the UAW said. In addition to a wage hike, the contract also has stipulations for higher pensions and the right to strike over company plans to close factories. 

Based on those rates, the highest-paid employees at Ford will ultimately be earning more than $40 an hour, up from $32, and have a base pay of $83,000 for a 40-hour-a-week workload. Meanwhile, recent hires will see their pay double over the next four years. As The Times notes, Ford initially offered to pay its workers 23 percent more, telling the union that it's what the company could afford without making big changes to its business. However, the UAW pushed for a bigger percentage and managed to reach this agreement with Ford by having thousands of its workers walk out over the past few weeks. 

Approximately 8,700 personnel at the company's largest truck plant in Kentucky had stopped working, along with another 10,000 in Illinois and Michigan. Around two weeks after the strikes began, Ford suspended the construction of a Michigan battery factory for electric vehicles "until [it's] confident about [its] ability to competitively operate the plant."

Ford, like other automakers, are taking steps to electrify its fleet in hopes of having an all electric vehicle lineup over the next 10 years or so. The automakers affected by the strike, which also include GM and Stellantis, previously said that their electrification efforts currently costing them billions of dollars would be affected by the union's demands. "Toyota, Honda, Tesla and the others are loving the strike, because they know the longer it goes on, the better it is for them," Ford executive chairman William C. Ford Jr. said. Tesla and the Japanese automakers aren't unionized, but the UAW argued that its success with the current strikes could give it the momentum it needs to expand and organize at other companies.

SAG-AFTRA video game actors vote in favor of strike action over wages and AI

SAG-AFTRA members have voted in favor of a strike authorization for performers working in video games, including those who do voice work, motion capture and stunts for the industry. Of the 34,687 members who cast their ballot, 98.32 percent voted "yes." It doesn't automatically mean that the performers are going on strike, only that they could after September 26. 

The guild explained that it's been negotiating for a new contract with video game companies since 2022, but that they "have refused to agree to critical terms [its] members need." For its next bargaining sessions on September 26, 27 and 28, it believes the strike authorization gives it the added leverage needed to get the companies to agree to its terms. At the moment, the guild is in talks with Activision, Blindlight, Disney Character Voices, Electronic Arts, Epic Games, Formosa Interactive, Insomniac Games, Take 2 Productions, VoiceWorks Productions and WB Games.

Specifically, SAG-AFTRA is fighting for wage hikes that would allow performers to make a living from their work in the face of inflation, as well as more rigorous safety measures on set. The guild is also fighting for a contract that would protect performers against exploitative uses of artificial intelligence, such as companies making unauthorized copies of their likeness and voice. These all mirror the issues that ignited the ongoing strikes in the film and TV industry. The Writers Guild of America (WGA) is believed to be nearing an agreement with major studios, with one of the last sticking points in their negotiations being the use of generative AI in content production.

The WGA strike may end as studios offer streaming and AI concessions

Following marathon negotiations over the last five days, the Writers Guild of America (WGA) and major studios have reached a tentative deal to end a 146-day strike that has shut down much of the industry, Variety has reported. "We can say, with great pride, that this deal is exceptional – with meaningful gains and protections for writers in every sector of the membership," the WGA wrote in an email to members.

Picketing has been suspended as of Sunday night, but the strike is still in force until it's ratified and approved by members. "To be clear, no one is to return to work until specifically authorized to by the Guild. We are still on strike until then," the email stated.

One of the last sticking points was reportedly around the use of generative AI in content production. Other details of the contract have yet to be released, including around streaming residuals, staffing levels for shows and more. "Though we are eager to share the details of what has been achieved with you, we cannot do that until the last ‘i’ is dotted," wrote the WGA.

Things were looking bleak for the industry in mid-September, but some high-profile WGA members reportedly pressured leadership to restart negotiations. In addition, four key AMPTP executives (Bob Iger from Disney, NBCUniversal’s Donna Langley, Ted Sarandos and David Zaslav of Warner Bros. Discovery) participated in negotiations for three days. Bargaining resumed on September 20, and the deal was reached five days later.

Considering the strike length and WGA leadership's high level of praise for the deal, a positive vote from membership seems probable. The guild credited membership's solidarity and its willingness to "endure the pain and uncertainty of the past 146 days" as key to clinching the deal. "It is the leverage generated by your strike, in concert with the extraordinary support of our union siblings, that finally brought the companies back to the table to make a deal," it stated in the message.

The labor strife isn't finished yet, though. The SAG-AFTRA actors' guild is still on strike after hitting picket lines on July 14 over issues like likeness rights. "While we look forward to reviewing the WGA and AMPTP’s tentative agreement, we remain committed to achieving the necessary terms for our members," the union wrote in a statement.

Even after the actors reach their own deal, it will take time for TV series, films, talk shows and other productions to get back up to speed — so expect delays in your favorite shows coming back. The AMPTP has yet to comment on the WGA deal.

Marvel Studios VFX workers have unanimously voted to unionize

Visual effects workers at Marvel Studios have unanimously voted to unionize in an election held by the National Labor Relations Board (NLRB). It's the first unit composed entirely of VFX workers to unionize with the International Alliance of Theatrical Stage Employees (IATSE), according to the union, which represents those who work in behind-the-scenes aspects of the entertainment industry. There were 41 eligible voters and all 32 who participated voted in favor of the union.

“Today, VFX workers at Marvel Studios spoke with a unanimous, collective voice, demanding fair pay for the hours they work, healthcare, a safe and sustainable working environment, and respect for the work they do," Mark Patch, a VFX organizer for IATSE said in a statement. "There could be no stronger statement highlighting the overwhelming need for us to continue our work and bring union protections and standards to all VFX workers across the industry."

Recent reports have suggested that Marvel demands a lot from its visual effects workers, especially after expanding its slate from a few movies a year to include several Disney+ TV shows. One person who was offered a short-term contract at the company told Vulture in January that Marvel expected 3,000 feature-quality VFX shots to be completed for a 10-hour TV series on a much shorter timeline than would be typical for one of its superhero movies (which tend to have around 1,600 VFX shots). The worker was reportedly told that he'd have to work 18 hours a day, seven days a week for three months solid and declined the offer.

Marvel, which also outsources much of its VFX work, will now have to sit down and negotiate a contract with the union's bargaining committee in good faith. IATSE notes that no negotiation dates have been scheduled as yet.

Another unit of VFX workers under the Disney umbrella could soon join the Marvel employees in having IATSE representation. Walt Disney Pictures VFX workers are currently voting in their own NLRB election. The results are expected on October 2.

Marvel’s visual effects workers vote to unionize

Marvel's visual effects employees have voted in favor of joining a union in their fight for better pay, overtime compensation, more benefits and better treatment. According to Vulture, a supermajority of the company's 50 on-set VFX employees have filed a petition for an election with the National Labor Relations Board. They're hoping to join the Theatrical Stage Employees (IATSE), which also represents hair and makeup artists, wardrobe, lighting and prop personnel, among other workers. Because apparently, despite Marvel's reliance on visual effects to make its universe(s), superheroes and supervillains look real on the big screen, its VFX artists aren't represented by a union. IATSE has also been campaigning broadly to expand its membership into VFX and animation workers in recent months.

Several current and former VFX employees for the company previously spoke out about grueling schedules and breaking down under pressure while working on shows and movies for the studio. Sources told IGN that people were being given tasks that were impossible to finish within the timeframe allowed to complete them. Some VFX artists told Vulture that the hectic production schedule for Ant-Man and the Wasp: Quantumania, for instance, led to rushed work and an end product that many reviewers had described as "bland."

VFX coordinator Bella Huffman said: "Turnaround times don't apply to us, protected hours don’t apply to us, and pay equity doesn’t apply to us. Visual effects must become a sustainable and safe department for everyone who's suffered far too long and for all newcomers who need to know they won’t be exploited."

Vulture says a strike by Marvel's VFX artists is not out of the question. It is a common tactic employed by workers seeking to organize, after all — plus, both the Writers Guild and the Screen Actors Guild are currently on strike to demand better pay, streaming residuals from successful shows and regulation of AI use in Hollywood.

Last month, around 80 Google Help subcontractors employed by Accenture — who recently voted to unionize with the Alphabet Workers Union-Communications Workers of America (AWU-CWA) — found out that they will be laid off. Now, the union has filed a complaint against Alphabet and Accenture with the National Labor Relations Board (NLRB) alleging retaliatory layoffs in violation of labor laws, the AWU-CWA wrote in a press release. 

"When my coworkers and I announced our union with overwhelming support, Google and Accenture management refused to acknowledge us," said general writer at Accenture and Google, Anjail Muhammad, in a statement. "A few short weeks later they announced their response — that they would be laying off dozens of employees. These jobs aren’t going away though, we’re just being asked to train our replacements abroad." 

Alphabet effectively washed its hands of the issue when the layoffs were first announced, saying that "Google does not control [the contractor's] employment terms or working conditions" and that the situation was "a matter between them and their employer, Accenture." It reiterated that position to Fortune, adding that the layoffs were for savings and efficiency and no other reason, and that it "chooses its partners and staffing agencies carefully and reviews their compliance with its Supplier Code of Conduct."

In their original union application, workers listed Google and Accenture as joint employers "due to the direct role both companies play in shaping working conditions," they said in the original unionization announcement. "We had exercised our right to organize as members of the Alphabet Workers Union-CWA in order to bring both Google and Accenture, a Google subcontractor, to the bargaining table to negotiate on several key demands, including layoff protections," said senior writer and union member Julia Nagatsu Granstrom back in July. 

The team, which largely works in content creation, will be reduced from 130 people to around 40. They were reportedly instructed to train replacements working from India and the Philippines. Since 2018, the majority of Google employees have been contractors.

“As we’ve shared, Accenture is responsible for these workers' employment terms, including staffing," Google spokesperson Courtenay Mencini told Engadget. "We, of course, respect their right to join a union or not, but it’s a matter between the workers and their employer, Accenture.”

In April, YouTube Music contractors voted unanimously to unionize, after winning a landmark legal victory with the NLRB forcing Google to the bargaining table to ratify their union contract. However, Alphabet indicated that it would still not negotiate with workers, saying it doesn't consider them as employees — meaning the issue is likely to wind up in a federal court.

Google lays off contractors who unionized last month

Around 80 Google Help subcontractors who recently voted to unionize with the Alphabet Workers Union-Communications Workers of America (AWU-CWA) found out last week that they will be laid off. The group began a hearing this week with the National Labor Relations Board (NLRB) regarding the complex issue of joint employment for contractors. “It really stinks of retaliation,” Casey Padron, a general writer on the team scheduled to lose her job in August, told Engadget today.

The group announced the unionization effort on Thursday, June 8th; around two-thirds of the workers were notified weeks later about the layoffs. The team includes writers and graphic designers who create internal and external content for the search giant, including Google Help support pages. They list Google and Accenture as joint employers “due to the direct role both companies play in shaping working conditions.” Because they were joint contractors employed by tech consultancy Accenture, they don’t appear to enjoy protections with the Worker Adjustment and Retraining Notification (WARN) Act, legislation passed in 1988 that provides certain rights for laid-off workers. (California is currently considering expanding protections for contract workers.)

“Last week we received news that 80 of our nearly 120 recently unionized Google Help coworkers would be laid off,” said Julia Nagatsu Granstrom, Senior Writer and member of the Alphabet Workers Union- CWA. “We had exercised our right to organize as members of the Alphabet Workers Union-CWA in order to bring both Google and Accenture, a Google subcontractor, to the bargaining table to negotiate on several key demands, including layoff protections.” Nagatsu Granstrom describes the layoffs as “absolutely unacceptable,” given the timing of an active union campaign “with overwhelming support from workers.”

The Google Help cuts follow a group of company contractors rating search results who were fired last month after announcing intentions to unionize with the same organization, the AWU-CWA. However, they were reinstated and promised backpay after filing Unfair Labor Practice charges with the NLRB.

Padron says the Google Help layoffs caught her off guard. “I was extremely surprised to hear about our team’s layoffs,” she told Engadget. “We are constantly told by Google and Accenture management how impressed they are with the quality of our work, so the timing of these layoffs looks suspiciously like retaliation for our union formation.” She says the employer’s proclaimed motive of budget tightening doesn’t add up. “They claimed that the cuts were a result of changes in budget allocation, but Accenture has also posted job listings that have our exact job description and project code.”

“These giant, wealthy corporations need to start living up to their own ‘core values’ and treating their workers with the dignity, respect, and humanity we deserve,” Padron added. “If these multi-billion dollar corporations can’t afford to provide humane working conditions to their employees, the business model needs radical change. Some of our operations managers and the Googlers we collaborate with have already expressed that Google’s help centers will suffer without our team. They will feel this loss, and they deserve to.”

Nagatsu Granstrom says the unionized workers will take “every recourse possible to support our impacted members and continue to organize workers at Google Help and beyond.” Padron echoes the upbeat, fighting tone. “If it’s Accenture and Google’s goal to demoralize us, they have failed,” she told Engadget. “We are more united than ever and will continue to fight for this job that so many of us love and rely on.”

Sega of America workers overwhelmingly vote to unionize

Workers at Sega of America have voted to unionize. In a union representation election with the National Labor Relations Board, the workers voted 91-26 in favor of their unit, which is called the Allied Employees Guild Improving Sega (AEGIS-CWA). Nineteen ballots were challenged, while three were void. As a result, the group has now officially organized with the Communication Workers of America

The unit comprises more than 200 workers in various departments across the company, including the brand marketing, games as a service, localization, marketing services, product development, sales and quality assurance teams. While it's hardlythe first games union in North America, the workers say it's "the largest multi-department union of organized workers in the entire gaming industry." However, ZeniMax Workers United/CWA includes around 300 quality assurance workers at ZeniMax Studios.

AEGIS-CWA plans to push for improved base pay and benefits, more staff to "eliminate overwork patterns" and more balanced workloads. The workers are also seeking remote work options, clearly defined responsibilities for each role and more.

Sega declined to voluntarily recognize the union. Management decided to "instead engage with known union-busters in an attempt to spread misinformation, fear and division," Winry Ramsey, a QA tester and AEGIS-CWA member previously said. Sega will now have to agree on a union contract with AEGIS-CWA.

"We are overjoyed to celebrate our union election win as members of AEGIS-CWA. From the start of this campaign, it has been clear that we all care deeply about our work at Sega," Sega translator and AEGIS-CWA member Ángel Gómez said in a statement. "Now, through our union, we’ll be able to protect the parts of our jobs we love, and strengthen the benefits, pay, and job stability available to all workers. Together we can build an even better Sega. We hope our victory today is an inspiration to other workers across the gaming industry. Together, we can raise standards for all workers across the industry.”
