Amazon, one of the world’s largest employers, has called the National Labor Relations Board ‘unconstitutional’

Amazon, a company that employs more than 1.54 million people, has claimed that the National Labor Relations Board Relations Board (NLRB), the federal agency responsible for protecting the rights of workers, is unconstitutional. Amazon made the claim in a legal document filed on Thursday as part of a case in which prosecutors from the Board have accused the e-commerce giant of discrimination against workers at an Amazon warehouse in Staten Island who had voted to unionize, according to The New York Times.

Amazon is not the first company to challenge the Board’s constitutionality. Last month, Elon Musk’s SpaceX sued the NLRB after the agency accused the company of unlawfully firing eight employees and called the agency “unconstitutional” in the lawsuit. Weeks later, grocery chain Trader Joe’s, which the NLRB accused of union-busting, said that the NLRB’s structure and organization was “unconstitutional,” Bloomberg reported. And in separate lawsuits, two Starbucks baristas have independently challenged the agency’s structure as they sought to dissolve their unions.

Amazon’s claim is similar to the existing claims filed by SpaceX and Trader Joe’s. In the lawsuit, the company’s lawyers argued that “the structure of the N.L.R.B. violates the separation of powers” by “impeding the executive power provided for in Article II of the United States Constitution.” In addition, Amazon claimed that the NLRB’s hearings “can seek legal remedies beyond what’s allowed without a trial by jury.”

Seth Goldstein, a lawyer who represents unions in the Amazon and Trader Joe’s cases told Reuters that these challenges to the NLRB increase the chances of the issue reaching the Supreme Court. And they might cause employers to stop bargaining with unions in hope that courts will finally strip the federal agency of its powers, Goldstein said. Amazon has a contentious history with the NLRB, which said the company broke federal labor laws last year.

Netflix says that game engagement tripled in 2023

Netflix said that user engagement with games on the service tripled in 2023. “[Despite] games still being small, and certainly not yet material relative to our film and series business, we’re pleased with this progress,” the company said in its earnings report on Tuesday. As an example, the company pointed to the addition of the Grand Theft Auto trilogy to the service last year, although it isn't clear how much the trilogy, which only arrived on Netflix on December 14, helped drive engagement in the final two weeks of the year. 

Netflix said that Grand Theft Auto has become its “most successful launch to date” in terms of installs and engagement. It didn’t say how many people had downloaded the trilogy since it was released on the platform, however. Some customers had signed up for Netflix just to play the Grand Theft Auto games, the company said.

That’s a big change from 2022, when and analysis from Apptopia and CNBC revealed that less than one percent of Netflix’s customers were playing games, which the company had made available to anyone with a Netflix subscription a year earlier. Despite the slow uptake, Netflix continued adding games to the platform. It’s growing gaming library includes popular titles like Hades, Dead Cells, Braid, Death’s Door and Katana Zero, as well as games such as Oxenfree II: Lost Signal, which it developed on its own after buying indie developer Night School. The platform also includes games based on its own popular original shows like Money Heist and The Dragon Prince.

Beyond gaming, Netflix said that it added 13.1 million subscribers in the last three months of 2023, the highest number of subscribers it has added since the explosive growth it experienced during the pandemic. The total number of Netflix subscribers around the world is now 260 million.

Google is laying off hundreds of workers who sell ads to big businesses

Days after laying off more than a thousand employees from Pixel, Nest, Fitbit, Google Assistant and core engineering divisions, Google is cutting “hundreds of roles” on its advertising sales team, a company spokesperson told Engadget on Tuesday.

“Every year we go through a rigorous process to structure our team to provide the best service to our Ads customers,” the company said in a statement. “We map customers to the right specialist teams and sales channels to meet their service needs. As part of this, a few hundred roles globally are being eliminated and impacted employees will be able to apply for open roles on the team or elsewhere at Google.”

The spokesperson declined to share information about the exact number of employees impacted by the cuts or where they were located. The news was first reported by Business Insider, which obtained a memo that Google’s chief business officer Philipp Schindler sent staff on Tuesday.

Google’s latest cuts continue the trend of layoffs at tech companies, which shed thousands of jobs in 2023. In the first two weeks of this year, for instance Amazon cut hundreds of workers in video game streaming service Twitch, Prime Video, MGM Studios, and Audible. Discord, Meta, Unity and Duolingo have also let go employees in 2024.

In December, The Information reported that Google was planning to reorganize its ad sales unit, which has more than 30,000 people, in favor of using machine learning to help customers buy more ads on flagship products like Google Search and YouTube, which is how the company makes a bulk of its revenue. Most of the company’s cuts taking place today will focus on ad sales teams selling ads to large businesses.

Meanwhile, the company is reportedly throwing millions of dollars of stock at select researchers at DeepMind, its artificial intelligence unit, to stop them from decamping to rivals like OpenAI.

Apple will reportedly reward artists for offering music in spatial audio

Apple will reward record labels and artists who offer their music in spatial audio, a relatively new audio format that is more immersive than regular stereo. According to a Bloomberg report, artists who release their music in spatial audio will receive “added weighting” starting next year. That, Bloomberg speculates, could mean higher royalties.

Nearly all of Apple’s audio hardware such as AirPods, HomePod, the iPhone and the upcoming Vision Pro headset, support playback in spatial audio, so the company’s move to incentivize artists is almost certainly to ensure that most music available on Apple Music is available in a format that Apple has positioned as a selling point. Notably, Bloomberg notes that Apple Music listeners wouldn’t necessarily have to stream a song in spatial audio for artists to be rewarded. Simply having their music available in the format would be enough.

Apple added spatial audio, which is powered by technology from Dolby Atmos, to Apple Music in 2021. Most of the company’s original shows and movies on Apple TV+ are also offered in the format. Artists also have the option of mixing their older music in the new format, something that bands from all decades are already doing. Mixing music in the format isn’t wildly expensive, according to Bloomberg; if true, this push could help get independent musicians and smaller acts on board.

Some Apple Music competitors like Amazon Music and Tidal also offer spatial audio on their services. But Spotify, Apple’s biggest music stream rival, is a notable exception, even though rumors about a high-quality music format on the service have swirled for years.

ChatGPT says that asking it to repeat words forever is a violation of its terms

Last week, a team of researchers published a paper showing that it was able to get ChatGPT to inadvertently reveal bits of data including people’s phone numbers, email addresses and dates of birth that it had been trained on by asking it to repeat words “forever”. Doing this now is a violation of ChatGPT’s terms of service, according to a report in 404 Media and Engadget’s own testing.

“This content may violate our content policy or terms of use”, ChatGPT responded to Engadget’s prompt to repeat the word “hello” forever. “If you believe this to be in error, please submit your feedback — your input will aid our research in this area.”

There’s no language in OpenAI’s content policy, however, that prohibits users from asking the service to repeat words forever, something that 404 Media notes. Under “Terms of Use”, OpenAI states that users may not “use any automated or programmatic method to extract data or output from the Services” — but simply prompting the ChatGPT to repeat word forever is not automation or programmatic. OpenAI did not respond to a request for comment from Engadget.

The chatbot’s behavior has pulled back the curtain on the training data that modern AI services are powered by. Critics have accused companies like OpenAI of using enormous amounts of data available on the internet to build proprietary products like ChatGPT without consent from people who own this data and without compensating them.

Amazon will start selling Hyundais through its website next year

Next year, Amazon will let you add a whole ass car to your shopping cart. The company announced today that it will launch vehicle sales in the US next year. The first cars available to purchase will be from Hyundai, as part of an Amazon partnership with the company, but more brands will presumably be added.

Buying a car on Amazon doesn’t seem to be super different from buying pretty much anything else on the website. According to an Amazon blog post, you’ll be able to search for vehicles in your area based on model, trim, color, and features. Once you’ve selected a car, you can choose to pick it up or have it delivered to a local dealership, and then check out using the same standard payment or financing options you normally use on the site. Do Prime members get free shipping? I sure hope so.

Hyundai is also building in Alexa into its cars starting in 2025 as part of its partnership with Amazon. This will let you ask Alexa to not only do the usual Alexa things like playing music and setting timers, but also ask for directions, traffic updates and weather reports, and control the car’s media player and navigation system.
