Apple offers to open up NFC payments to rival companies in EU antitrust case

The long-running dispute between the European Commission and Apple over the use of its payment technology could soon come to an end. The Commission has officially announced Apple's plan to open up its Near-Field Communication (NFC) technology, used for tap-and-go payments, to third-party mobile wallet providers. Rumors of Apple's proposal first surfaced in December 2023.

The Commission opened an investigation into Apple in 2020 over potentially restricting rival mobile wallet pay developers' access to necessary technology, thus eliminating Apple Pay's competition. Two years later, it announced charges against Apple for allegedly violating the European Union's antitrust laws, which, if proven, could leave Apple with a massive bill.

Apple's proposal compromises on its previous assertions that third parties could negatively impact security. If approved, Apple would, among other things, allow third parties to APIs with NFC functionality — no fee or use of Apple Pay or wallet required. This shift would include access to technology that keeps payment information secure. Apple would apply this to any developers and iOS users registered in the European Economic Area (EEA). However, people outside the EEA might still be able to use third-party apps. Apple also claims it will call upon an independent reviewer in disputed instances where the company denied NFC access. As expected, the European Commission has not rushed to accept Apple's proposed commitments. Instead, it has laid them out and requested feedback from Apple's rivals (and any other interested entities) on whether the laid-out changes are acceptable.

Apple is now selling Watch Series 9 and Ultra 2 with disabled blood oxygen monitor

If you're in the US, any Watch Series 9 or Ultra 2 model you buy from Apple will no longer have a functional blood oxygen monitoring feature. Apple failed to convince the court to allow it to keep selling the aforementioned models while it's appealing a ruling by the US International Trade Commission (ITC). If you'll recall, the commission found that Apple had violated patents owned by medical technology company Masimo, which accused the iPhone-maker of infringing on its intellectual properties related to light-based blood-oxygen monitoring. The ITC ordered the company to stop selling the contested watches.

Apple pulled the Watch models from its website and stores in December before the the ban took effect as a preemptive measure. A few days later, though, the company put them back up for sale after a federal appeals court in Washington D.C. granted it a temporary pause on the import and sales ban. Now, the appeals court has lifted the stay and ordered Apple to stop selling both models again by 5PM ET on January 18. 

The company, however, is able to skirt the ban, because the US Customs and Border Protection (CBP) recently decided that redesigned watches without a pulse oximetry functionality fall outside the scope of the ITC's ruling. In a statement sent to 9to5Mac, Apple said it believes "the US Court of Appeals for the Federal Circuit should reverse the USITC’s decision" and that it strongly disagrees with it and the resulting orders. "Pending the appeal, Apple is taking steps to comply with the ruling while ensuring customers have access to Apple Watch with limited disruption," the spokesperson added. "These steps include introducing a version of Apple Watch Series 9 and Apple Watch Ultra 2 in the United States without the Blood Oxygen feature." The company also clarified that there "is no impact to Apple Watch units previously purchased that include the Blood Oxygen feature."

The modified watches will still have the blood monitoring app, Apple told the publication, but you will get a message that says it's no longer available when you tap on it. That message also tells you to go the Health app on your iPhone to learn more, where you'll then see a link to a support article on the company's website. 

Even before the ITC's ban took effect, Apple was already reportedly scrambling to create a software update that would allow it to sell the devices involved. Clearly, the company was able to develop a solution in time for the stay to be lifted. While the ban isn't officially taking effect until the afternoon of January 18, you'll already see a note that says "Apple Watch Series 9 and Ultra 2 no longer include the blood oxygen feature" when you visit the company's website and access either model's product page. Engadget reached out to Apple, and while it confirmed the resumed US availability of both watch models, it refused to comment on the matter.

When a PS5 remake of the 2013 title The Last of Us Part I launched, it was hard to stomach the $70 price tag. Yes, the game looked incredible, there were some new modes, but the level design and gameplay were identical. It was, for all intents and purposes, a money grab.

Yamaha is a pillar of the electronic music-making world, but it’s perhaps best known for its stage synthesizers and studio monitors. Now, it’s taking Teenage Engineering with the SEQTRAK groovebox. Stylistically, it seems heavily inspired by TE.

The SEQTRAK includes a drum machine, sampler, FM and sample-based synthesizers and that semi-eponymous sequencer along with a built-in battery (three to four hours expected playtime) plus a built-in speaker, so it works without plugging in anything else. The SEQTRAK is available to pre-order at retailers for $399, which undercuts the heady pricing of Teenage Engineering’s similar product.

Apple shipped more smartphones than anyone else last year

It’s the first time Apple has held the top spot.

Both IDC and Canalys’ most recent analysis of smartphone shipments shows Apple has beaten Samsung to roll out more smartphones than any other company. IDC’s preliminary data said Apple shipped 234.6 million units in 2023, equal to 20.1 percent of the market share. In comparison, Samsung shipped 226.6 units for 19.4 percent of the market share. This is the first time Samsung has fallen from the number-one spot since 2010. 

Back then, Nokia was in the lead.

The Morning After: If you want to test Apple’s Vision Pro, it’ll take some time

After a fairly long wait, Apple’s debut mixed reality headset — its first new device since the Apple Watch — is almost here. The Vision Pro launches on February 2, and to ensure it fits as well in demos as it will in real life, you’ll have to put most of an hour aside to play.

According to Bloomberg’s Mark Gurman, customers who ask for a demo will have to go through face scans and the assembly of a custom Vision Pro, before sitting through a walkthrough of the interface, controls and device calibration. Apple Store employees will even scan glasses to figure out lens prescriptions for the Vision Pro. All of that could well burn through any intrigue and excitement for the headset, but at least you’ll get a meaty 25-minute demo.

If you’re planning to buy a Vision Pro in-store without trying, you maverick, you’ll still have to go through the face scans. However, you can jump through the rest of the hoops in your own time back home.

Apple will remove Blood Oxygen app from Watch Series 9 and Ultra 2 to evade US import ban

Federal officials said the company can bypass the ban after a redesign.

According to a letter from Masimo, the company in a patent dispute against Apple, to an appeals court judge, the latter’s latest Watches can skirt the recent import ban by removing the Blood Oxygen app from Apple Watch units sold in the US. According to 9to5Mac, this won’t affect those who already have an Apple Watch with pulse oximetry features. Apple will likely roll out a new version of the Blood Oxygen app to affected units once it resolves the patent problem.

Microsoft introduces Copilot Pro: a $20 monthly subscription for advanced AI

It’s been almost a year since Microsoft launched its ChatGPT-powered Bing Chat — now just called Copilot. So it’s time to make money, of course! Like OpenAI did with ChatGPT as its popularity grew, Microsoft is launching Copilot Pro, a $20 monthly subscription that gives access to the very latest ChatGPT releases, as well as access to Copilot in Microsoft 365 apps and other new features.

What might be more interesting for power users, though, is Copilot GPT, a new feature that lets you tweak the AI chatbot around specific topics, including fitness and cooking. Pro users will also eventually be able to create their own Copilot GPTs.

Apple ends Samsung’s decade-plus run as global smartphone shipment leader

The year 2023 turned out to be a big one for Apple's iPhone. First, it got rid of the longstanding lightning port, and now reports indicate that Apple overtook Samsung for the title of most smartphones shipped globally. The International Data Corporation (IDC) Worldwide Quarterly Mobile Phone Tracker's preliminary data found that Apple shipped 234.6 million units in 2023, which is equal to 20.1 percent of the market share. In comparison, Samsung shipped 226.6 units for 19.4 percent of the market share. Canalys, a global technology market analyst firm, shared findings that mirrored those from the IDC.

This instance marks the first time Samsung has fallen out of the number one spot since 2010, when Nokia was in the lead and Apple didn't even crack the top five. In 2023, Xiaomi, OPPO and Transsion took the remaining three spots with 145.9, 103.1 and 94.9 million smartphones shipped globally, respectively. 

The shift is notable given the crowding and continued regulations in the smartphone industry. "Apple certainly played a part in Samsung's drop in rank, but the overall Android space is diversifying within itself. Huawei is back and making inroads quickly within China, Brands like OnePlus, Honor, Google, and others are launching very competitive devices in the lower price range of the high end. And foldables and increased discussions around AI capabilities on the smartphone are gaining traction," Ryan Reith, IDC's Worldwide Mobility and Consumer Device Trackers group vice president, explained in a statement. "Overall, the smartphone space is headed towards a very interesting time."

Notably, overall smartphone shipments declined by 3.2 percent in 2023 but increased by 8.4 percent in quarter four. However, Apple is struggling to compete in China, with quarter four sales in the region 11 percent lower than the previous year, the Wall Street Journal reports. The company has cut its iPhones by the equivalent of about $70 ahead of Lunar New Year, a time filled with presents. Discounting its most recent iPhone, in this case the iPhone 15, is a rarity for Apple but could have a payoff in a struggling market.

The subscription also grants you better AI image creation, which will be faster and deliver higher image quality, with optional landscape formatting. It's also worth noting that Copilot Pro is $20 a month per user — plan to shell out more if multiple people in your household need access. 

While Copilot and Microsoft's onslaught of AI announcements throughout 2023 led to plenty of publicity — it actually made us care about poor old Bing again! — it remains to be seen if it actually ends up being useful to general users. That may explain the rush to monetize Copilot for power users so quickly. Copilot queries are expensive, both in terms of computation power and energy use, so Microsoft needs a way to actually recoup some of those costs from its most aggressive users. The company also needs to make good on its $13 billion investment in OpenAI, which gave it a 49 percent stake in the AI firm (and once again raised regulatory scrutiny).

Given how strongly linked they are, it's no wonder Microsoft CEO Satya Nadella was instrumental in getting OpenAI co-founder Sam Altman re-instated as CEO, following a dramatic battle with the company's board of directors.

Alongside Copilot Pro, Microsoft says that Copilot for Microsoft 365 is now widely available to small companies with its "Business Premium" and "Business Standard" subscriptions. The pricing hasn't changed from its earlier enterprise launch, though: It's still $30 a month per person (except now you can buy between 1 and 299 seats).

The 11-inch screen is a touch bigger and better, with a 2,000 x 1,200 resolution. Other notable features include 8MP front and rear-facing cameras and 4GB of RAM. This version comes without lock screen ads and is currently only $5 more than the 64GB model with lock screen ads. 

Rounding out the Amazon Fire tablet deals is the 32GB Amazon Fire HD 8 Plus tablet, with a 38 percent discount, dropping it to $75 from $120. It comes with a 2MP front-facing camera and 5MP rear-facing cameras. It has 3GB of RAM and works 30 percent faster than its predecessor. If you want to demo the Vision Pro at an Apple Store, prepare to be there a while

We’re getting closer and closer to launch day for Apple’s Vision Pro headset, which means if you’re not yet sold on ordering one, you’ll soon be able to try it out in the store. But don’t expect the process to be quick and easy. In the Power On newsletter this week, Bloomberg’s Mark Gurman says customers hoping for a demo will each have to go through face scans and the subsequent assembly of a custom Vision Pro, a walkthrough of the interface and all the controls, and device calibration — all before a 25-minute demonstration of the Vision Pro experience.

The Vision Pro is meant to sit just right on its wearer’s face, with multiple sizing options for the light seal, foam cushion and band. And Apple isn’t planning on taking the risk of an attempted universal fit for in-store demos, according to Gurman. In addition to face scans, employees will have a device to scan customers’ glasses to determine the right prescription for Vision Pro lenses. Each store “will have hundreds of lenses on hand for demos,” Gurman says, and employees will tag-team the process, with one on the floor taking customers’ details and another in the back handling assembly.

Some stores will have at least a dozen Vision Pro headsets around for people to try. During the actual demo, according to Gurman, users will be shown a series of normal, panorama and “spatial” photos, spatial videos, immersive experiences including a “scene that makes users feel as if they’re on a tightrope,” and a glimpse at what it will be like using the Vision Pro as a computer. Signups will start at 8AM local time on February 2.

If you’re just walking in to buy a Vision Pro, the process should be much simpler. You’ll have to go through the face scans — as will anyone ordering one online — and then all the correct pieces will be boxed up for you right there, Gurman says. There will also be multiple display-only units in each store, if you just want to take a look.
