SAG-AFTRA strikes against League of Legends over voiceover company actions

SAG-AFTRA has called a strike against the video game League of Legends. Under this action, any union voice actors must cease working on the popular MOBA from Riot Games. The union said it has also filed a charge of unfair labor practice against Formosa Interactive, which provides voiceover services for League, with the National Labor Relations Board.

Formosa Interactive was one of several high-profile video game companies named in a strike by voice acting talent earlier this year. SAG-AFTRA is working to negotiate with those developers for protections against AI replicas of its members, including those who perform in games.

Today, the union alleged that Formosa attempted to “cancel” a game that was included in the strike. "When they were told that was not possible, they secretly transferred the game to a shell company and sent out casting notices for “non-union” talent only," according to the press statement. "SAG-AFTRA charges that these serious actions are egregious violations of core tenets of labor law – that employers cannot interfere with performers’ rights to form or join a union and they cannot discriminate against union performers."

League of Legends is just one of the titles where Formosa Interactive provides services. In addition to voiceover work, Formosa Interactive also offers services such as facial capture, sound design and mixing. It has credits on games including God of War Ragnarok, Apex Legends, Genshin Impact, The Legend of Zelda: Breath of the Wild and Microsoft Flight Simulator.

Riot Games has issued the following statement about the strike: "League of Legends has nothing to do with the complaint mentioned in SAG-AFTRA’s press release. We want to be clear: Since becoming a union project five years ago, League of Legends has only asked Formosa to engage with Union performers in the US and has never once suggested doing otherwise. In addition, we’ve never asked Formosa to cancel a game that we’ve registered. All of the allegations in SAG-AFTRA’s press release relating to canceling a game or hiring non-union talent relate to a non-Riot game, and have nothing to do with League or any of our games."

Hundreds of Amazon drivers in NYC join the Teamsters union

Hundreds of Amazon drivers in New York City have joined the Teamsters union in the hope of obtaining better pay and working conditions. The union says a majority of drivers at each of three delivery service partners (DSPs) working out of a Queens warehouse have signed authorization cards.

According to a Teamsters press release, the drivers have been organizing for a year to secure fair pay, consistent schedules, reasonable workloads and proper pay maintained trucks. They walked off the job last December as part of a nationwide protest against Amazon’s alleged unfair labor practices and union-busting efforts.

At least on paper, joining the union should give the drivers more leverage as they push Amazon for better working conditions. But that doesn’t necessarily mean the company will play ball. The Amazon Labor Union, one of the first major successful organization efforts within the company in the US, has yet to secure a union contract, two years after forming. The group became a Teamsters affiliate this summer.

However, the union has found some success on behalf of Amazon workers. Last month, a regional National Labor Relations Board director determined that Amazon is a joint employer of some third-party drivers in Palmdale, California. The Teamsters hope that finding will set a precedent for the rest for DSP drivers elsewhere. The Queens drivers are the first Amazon workers to organize with the Teamsters following that decision.

An Apple Store in Oklahoma City is close to approving an union agreement for its workers

Talks between Apple and the union for the Apple Store in Oklahoma City have produced a tentative agreement that includes new benefits and protections for its staff. The Penn Square Mall Apple Store in Oklahoma City announced they’ve reached a “tentative labor agreement” with Apple and the Communication Workers of America (CWA), according to a released statement.

Terms are still being negotiated between both parties but the benefits for the store’s employees would be significant. The three-year agreement reached between the CWA and Apple would give employees a wage increase of up to 11.5 percent. An Apple spokesperson said by email that if the contract is ratified, employees would receive a 4 percent raise in the first year of employment and 3 percent in the second and third year each “based on employee performance.”

The agreement would also offer employees guaranteed paid time off and health and other benefits, allow employees to have a say in scheduling and the establishment of a “safer and more democratic workplace” through a grievance submission process with committees overseeing safety, health and working relations. An Apple spokesperson also noted the scheduling options “were provided to all other US stores in 2022.”

The Oklahoma City Apple Store had been working to form a union since 2022, becoming the second Apple Store in the US to unionize. Employees passed a strike authorization vote in August that passed with unanimous support and started a picket in front of the store ahead of bargaining sessions in early September. Workers will vote to ratify the tentative agreement on September 22.

CWA District 6 Vice President Derrick Osobase called the agreement achievement “a historic day for our members who have now secured a contract at the world’s most profitable company.”

The Apple Store in the Towson Town Center in Towson, Maryland became the first location to unionize. Members approved the union in 2022 with the International Association of Machinists and Aerospace Workers (IAM). A store in the Cumberland Mall in Atlanta, Georgia tried to form a union in 2022 with the CWA but workers called it off accusing Apple of committing “repeated violations of the National Labor Relations Act.”

Microsoft and Activision Blizzard accused of ‘bad faith bargaining’ by Raven Software union workers

Raven Software’s union — the first of its kind in the gaming industry — has hit another snag negotiating its collective bargaining agreement with Microsoft and Activision Blizzard, games journalist Stephen Totilo reported in his Game File newsletter. The union has filed an unfair labor practice complaint with the National Labor Relations Board (NLRB), alleging chiefly that their employer refuses to bargain, or is not bargaining in good faith. The Raven workers succeeded in their union drive, joining the Communications Workers of America (CWA), over two years ago.

The full complaints have not been made available to the public as of Wednesday. We also reached out to Microsoft and Activision Blizzard for a comment on the complaint but did not receive a response as of presstime.

CWA president Claude Cummings Jr. released a statement following the unfair labor practice charges. He urged Microsoft to follow through on its agreement to respect the rights of the Raven Software workers’ union efforts.

“After Microsoft’s acquisition of Activision Blizzard, our members were optimistic that they would progress quickly to a first contract at Raven Software,” Cummings wrote. “Unfortunately, that has not happened. We encourage Microsoft to address the concerns raised in the unfair labor practice charge and make reaching a fair agreement a priority.”

An NLRB investigation revealed Activision Blizzard withheld raises from Raven’s workers following a separate unfair labor practice charge. The complaint filed by the CWA on behalf of workers in 2022 also accused the game publisher of retaliating against workers attempting to form a union by laying off staff members and moving QA workers to separate teams.

The International Association of Machinists and Aerospace Workers’ Coalition of Organized Retail Employees (IAM CORE) said it’s been negotiating with Apple since January 2023. Under the tentative three-year agreement they’ve now reached, workers would be given average raises of 10 percent over the life of the contract, and starting pay rates for most positions would go up. The agreement would also establish a severance clause. The union represents about 85 employees, who will get to vote on the agreement on August 6.

Video game performers will strike over AI concerns

The SAG-AFTRA union today called for a strike against several major video game publishers after failing to reach an accord over AI use. The action will take effect at 12:01 am on July 26.

"We're not going to consent to a contract that allows companies to abuse A.I. to the detriment of our members," SAG-AFTRA President Fran Drescher said."Enough is enough. When these companies get serious about offering an agreement our members can live – and work – with, we will be here, ready to negotiate."

SAG-AFTRA performers working in games "deserve and demand the same fundamental protections as performers in film, television, streaming, and music: fair compensation and the right of informed consent for the A.I. use of their faces, voices, and bodies," said the union's National Executive Director & Chief Negotiator Duncan Crabtree-Ireland.

The union has been lobbying the video game industry to agree to protections against its members' likenesses and voices being recreated with AI. SAG-AFTRA entered negotiations with the companies for the Interactive Media Agreement in October 2022. Other studios, such as Replica Games, have agreed to the union's contract. The union also secured a similar deal for animated TV shows earlier this year.

A spokesperson for the gaming companies included in the Interactive Media Agreement, Audrey Cooling, provided a statement on behalf of the businesses. ​​“We are disappointed the union has chosen to walk away when we are so close to a deal, and we remain prepared to resume negotiations," she said. "We have already found common ground on 24 out of 25 proposals, including historic wage increases and additional safety provisions. Our offer is directly responsive to SAG-AFTRA’s concerns and extends meaningful AI protections that include requiring consent and fair compensation to all performers working under the IMA. These terms are among the strongest in the entertainment industry."

World of Warcraft workers unlock ‘form a union’ achievement

World of Warcraft (WoW) artists, designers, engineers, producers, quality assurance (QA) testers and other game developers have unionized. The staff of more than 500 workers voted to unionize the Blizzard Entertainment studio with the Communications Workers of America (CWA) creating the World of Warcraft Gamemakers Guild, according to an X post from the union’s official account.

The Blizzard studio is the latest major game studio to form a union during uncertain times of layoffs and studio closures across the gaming industry. Bethesda Game Studios, the studio behind the Fallout and Elder Scrolls franchises, formed its union with the help of CWA last weekend that includes 241 workers.

“What we’ve accomplished at World of Warcraft is just the beginning,” said Eric Lanham, a test analyst and Wow Gamemakers Guild member, in a statement released by the CWA. “My colleagues and I are embarking on a quest to secure better pay, benefits, and job security through a strong union contract. We know that when workers have a protected voice, it’s a win-win for employee standards, the studio, and World of Warcraft fans looking for the best gaming experience.”

The World of Warcraft Gamemakers Guild is the largest wall-to-wall union currently under Microsoft’s umbrella. Activision unionized around 600 QA workers with the CWA in March. ZeniMax Studios also voted to unionize around 300 staffers back in January.

Microsoft also made an agreement with Activision Blizzard two years ago to respect the right of its workers to form a union. The agreement was part of Microsoft’s deal to takeover Activision Blizzard.

The CWA cites the start of the WoW Gamemakers Guild formation to a protest conducted by Activision Blizzard workers in 2021. The crew staged a walkout at its Irvine, California headquarters over a lawsuit filed by the state’s Civil Rights Department (CRD) alleging the company was a “breeding ground for harassment and discrimination against women.” The CRD later withdrew all allegations of systemic sexual harassment, and Activision Blizzard reached a settlement of $54.8 million relating to pay and promotion disparities. The WoW studio also agreed to remove “references that are not appropriate for [its] world” from the game.

“What seemed impossible six years ago is now a reality, and this is just the beginning,” said CWA’s Senior Director of Organizing Tom Smith in a written statement. “Together, workers are redefining their industry.”

The workers at Bethesda Game Studios have fully unionized

The workers at Bethesda Game Studios have joined the Communications Workers of America (CWA), and they say they're the first Microsoft video game studio to form a wall-to-wall union. A total of 241 workers have either signed an authorization card or have indicated that they wanted to join a union through an online portal. The "wall-to-wall" nature of their organization means the CWA will be representing workers across job descriptions and divisions — and not just one type — including artists, engineers, programmers and designers. Bethesda is the developer behind Starfield and the Elder Scrolls and Fallout games.

Microsoft has already recognized the union, so workers at the studio's Maryland office have officially joined CWA Locals 2108, while those in its Texas office have become members of CWA Locals 6215. "We are so excited to announce our union at Bethesda Game Studio and join the movement sweeping across the video game industry," Mandi Parker, Bethesda Senior System Designer, said. "It is clear that every worker can benefit from bringing democracy into the workplace and securing a protected voice on the job. We’re thrilled to get down to brass tacks and win a fair contract, proving that our unity is a source of real power to positively shape our working conditions, our lives, and the company as a whole."

Bethesda's workers join the growing number of unionized personnel in video games. In January 2023, quality assurance workers at ZeniMax Studios, the parent company of Bethesda, banded together to form what was then the largest union in the industry with 300 members. It lost the distinction as the largest union in video games when 600 quality assurance workers at Activision, which is also owned by Microsoft, joined the CWA this year.

Amazon Labor Union partners with International Brotherhood of Teamsters in New York

Amazon workers have taken another step towards fighting for worker protections. The Amazon Labor Union (ALU) is teaming up with the International Brotherhood of Teamsters (IBT), a century-plus-old labor union active in the United States and Canada. The duo announced the partnership in a joint statement on X (formerly Twitter) following a vote that saw 98.3 percent of ALU members in favor of it.

"Together, with hard work, courage, and conviction, the Teamsters and ALU will fight fearlessly to ensure Amazon workers secure the good jobs and safe working conditions they deserve in a union contract," Teamsters General President Sean M. O'Brien said in a statement. ALU-IBT Local 1 will represent about 5,500 JFK8 Amazon warehouse workers in Staten Island but will "have jurisdiction" for warehouse workers throughout New York City.

Staten Island served as a point of pride when, in April 2022, the ALU secured enough votes to make JFK8 Amazon's first unionized warehouse in the US — one year after the ALU formed. However, Amazon tried overturning the vote, alleging "inappropriate and undue influence" from the National Labor Relations Board (NLRB). The conflict has since escalated, with the NLRB accusing Amazon of discriminating against the unionized workers in Staten Island and Amazon claiming in a legal filing earlier this year that the NLRB is "unconstitutional."

As the fight continues, ALU President Chris Smalls states that "having the support of 1.3 million Teamsters to take on Amazon gives us tremendous worker power and the opportunities to demand better conditions for our members and, most importantly, to secure a contract at JFK8."
