Apple Store employees in Oklahoma City ratify their first union contract

Employees at an Apple Store in Oklahoma City's Penn Square Mall have voted to ratify their first collectively-bargained contract. The store's workers are part of the Communications Workers of America, operating as Apple Retail Union-CWA Local 6016. The employees' three-year agreement with Apple includes the following, according to a press release from CWA:

  • "Wage increases of up to 11.5% over the next three years."

  • "Worker involvement in scheduling and guaranteed paid time off to vote."

  • "A safer and more democratic workplace with a grievance and arbitration process and the establishment of joint Safety and Health and Working Relations committees."

  • "Job protection in the event of a store closure or relocation and severance pay."

  • "Guaranteed paid time off, health and other benefits."

It's worth pointing out that though the CWA press release says the wage increases are "of up to 11.5 percent over the next three years," Apple has said that this number is actually an average 10 percent increase over three years instead.

An Apple spokesperson said “At Apple, we work hard to provide an excellent experience for our team members and our customers. We have always paid our retail teams in the top tier of the market and we provide exceptional benefits for all full- and part-time employees. Throughout this process, we have bargained in good faith and this agreement allows Penn Square team members to enjoy similar performance-based wage increases this year as last year, along with the same medical and time away benefits our U.S. retail employees currently receive.”

Apple also shared more details around compensation and wages like how the tentative agreement provides an average 10 percent increase over 3 years. Penn Square Mall employees will also be able to participate in the scheduling options that were provided to all other US stores in 2022, and held to the same availability guidelines as the rest of the fleet with no exceptions. PSQ members will receive the same medical and time off benefits as all US team members, and subject to the same documented coaching, discipline and misconduct practices that apply across all of Apple's US stores.

Apple's spokesperson also said the agreement includes the creation of a safety committee at the PSQ location, like the one at all its other stores. A working relations committee, made up of two representatives from the union and two from the company, will meet twice a year.

Today's news caps off years of preparation to unionize and secure a contract for the Penn Square Mall Apple Store, which began organizing in early 2022. The parties reached a tentative agreement in early September after a unanimous strike authorization vote in August and a store picket.

The Oklahoma City employees are the second group of Apple retail workers to reach a contract through their union. An Apple Store in Maryland was the first of the tech company's retail stores to unionize, joining the International Association of Machinists and Aerospace Workers in June 2022.

Apple TV will make three classic Peanuts specials free to stream

No Halloween, Thanksgiving or Christmas is complete without viewing one of the holiday adjacent Peanuts specials. These days, Apple TV owns the television rights to It’s the Great Pumpkin, Charlie Brown, A Charlie Brown Thanksgiving and A Charlie Brown Christmas but it appears that Apple TV wants everyone to have a chance to enjoy these Peanuts specials this year.

Apple announced that it’s making all three Peanuts specials available to everyone regardless of whether or not they have an Apple TV subscription. Apple TV will make each of the Peanuts holiday specials available on two days each month before Halloween, Thanksgiving and Christmas.

It’s the Great Pumpkin, Charlie Brown will be free to stream on October 19 and 20. The Peanuts Halloween special features Linus waiting up for the return of the Great Pumpkin while Charlie Brown only gets rocks while trick or treating.

A Charlie Brown Thanksgiving will be available to stream on November 23 and 24. This Thanksgiving special features Peppermint Patty inviting the whole gang to a Thanksgiving feast while Snoopy puts together his own Thanksgiving meal.

A Charlie Brown Christmas will stream for free on December 14 and 15. It’s perhaps the most famous Peanuts special with too many iconic moments to count from Snoopy’s prize winning holiday display to that sad little tree that the gang turn into a mighty Christmas tree just by waving their arms around it. It also features one of the greatest musical scores ever written for television by Lee Mendelson and Vince Guaraldi.

FTX advisor and Alameda CEO Caroline Ellison gets two years in prison

A US district court judge sentenced Caroline Ellison, the former advisor and ex-girlfriend to the convicted crypto fraudster and FTX founder Sam Bankman-Fried, to two years in prison.

The New York Times reported Ellison’s sentence for her role in the $8 billion in fraud committed by the FTX crypto exchange that sent Bankman-Fried to federal prison for 25 years back in March. Ellison will also have to serve three years of supervised release once she’s finished her prison sentence.

Ellison pled guilty at the end of 2022 to seven counts of fraud just as Bankman-Fried was being extradited to the US from the Bahamas. US Securities and Exchange Commission (SEC) Director of Enforcement Sanjay Wadhwa said following Ellison’s plea that she and Wang “were active participants in a scheme to conceal material information from FTX investors.”

Ellison was also the former chief executive officer of FTX’s sister company Alameda Research. Prosecutors said she diverted FTX customers’ funds onto Alameda’s books to hide risks from their clients. Ellison testified against Bankman-Fried, making her a key witness in his criminal fraud trial.

Prosecutors also got Bankman-Friend’s house arrest and bail revoked when a judge determined the FTX founder tried to hinder Ellison’s testimony last year. Bankman-Fried tried to message FTX’s general counsel on Signal and email in 2023 to influence Ellison’s testimony who was only identified as “Witness-1.”

Nine months later, Bankman-Fried showed a New York Times reporter personal writings from Ellison that prosecutors said were an attempt to damage her reputation especially amongst prospective jurors. The judge agreed both instances merited Bankman-Fried’s arrest and jailing while he awaited trial. Bankman-Fried is currently serving his 25-year sentence in a federal prison in Brooklyn awaiting appeal for his conviction.

Ellison issued a statement before her sentence apologizing for her crimes to the people she and her former firm defrauded. Prosecutors did not issue a recommended sentence and characterized her cooperation with investigators as “exemplary” in a memo to the judge.

“Not a day goes by that I don’t think of the people I hurt,” Ellison said in court. “I am deeply ashamed of what I have done.”

Cards Against Humanity is suing SpaceX for trespassing and filling its property with ‘space garbage’

Cards Against Humanity is the latest entity to take on Elon Musk in court. The irreverent party game company filed a $15 million lawsuit against SpaceX for trespassing on property it owns in Texas, which happens to sit near SpaceX facilities.

According to a lawsuit filed in a federal court in Texas, Musk's rocket company began using its land without permission for the last six months. SpaceX took what was previously a “pristine” plot of land “and completely fucked that land with gravel, tractors, and space garbage,” CAH wrote in a statement.

As you might expect from the card game company known for its raunchy sense of humor and headline-grabbing stunts, there’s an amusing backstory to how it became neighbors with SpaceX in Texas in the first place. In 2017, the company bought land along the US-Mexico border as part of a crowdfunded effort to protest then President Donald Trump’s plan to build a border wall. Since then, the company writes, it has maintained the land with regular mowing, fencing and “no trespassing” signs.

SpaceX later purchased adjacent land and, earlier this year, allegedly began using CAH’s land amid some kind of construction project. From the lawsuit (emphasis theirs):

The site was cleared of vegetation, and the soil was compacted with gravel or other substance to allow SpaceX and its contractors to run and park its vehicles all over the Property. Generators were brought in to run equipment and lights while work was being performed before and after daylight. An enormous mound of gravel was unloaded onto the Property; the gravel is being stored and used for the construction of buildings by SpaceX’s contractors along the road. Large pieces of construction equipment and numerous construction-related vehicles are utilized and stored on the Property continuously. And, of course, workers are present performing construction work and staging materials and vehicles for work to be performed on other tracts. In short, SpaceX has treated the Property as its own for at least six (6) months without regard for CAH’s property rights nor the safety of anyone entering what has become a worksite that is presumably governed by OSHA safety requirements.

SpaceX, according to the filing, “never asked for permission” to use the land and “and hasnever reached out to CAH to explain or apologize for the damage.” The rocket company did, however, give “a 12-hour ultimatum to accept a lowball offer for less than half our land’s value,” according to a statement posted online. A spokesperson for CAH said the land in question is “about an acre” in size.

In response to the ultimatum, CAH filed a $15 million lawsuit against SpaceX for trespassing and damaging its property. The game company, which originally was funded via a Kickstarter campaign, says that if it’s successful in court it will share the proceeds with the 150,000 fans who helped originally purchase the land in 2017. It created a website where subscribers can sign-up for a chance to get up to $100 of the potential $15 million payout should their lawsuit succeed. (A disclaimer notes that “Elon Musk has way more money and lawyers than Cards Against Humanity, and while CAH will try its hardest to get me $100, they will probably only be able to get me like $2 or most likely nothing.)

SpaceX didn’t immediately respond to a request for comment. But CAH isn’t the only Texas landowner that's raised questions about the company’s tactics. SpaceX has been aggressively growing its footprint in Southern Texas in recent years. The expansion, which has resulted in many locals selling their land to SpaceX, has rankled some longtime residents, according to an investigation published by Reuters.

CAH says that Musk’s past behavior makes SpaceX’s actions “particularly offensive" to the company known for taking a stance on social issues. 

“The 2017 holiday campaign that resulted in the purchase of the Property was based upon CAH undertaking efforts to fight against ‘injustice, lies, [and] racism,” it states. “Thus, it is particularly offensive that these egregious acts against the Property have been committed by the company run by Elon Musk. As is widely known, Musk has been accused of tolerating racism and sexism at Tesla and of amplifying the antisemitic ‘Great Replacement Theory.’ Allowing Musk’s company to abuse the Property that CAH’s supporters contributed money to purchase for the sole purpose of stopping such behavior is totally contrary to both the reason for the contribution and the tenets on which CAH is based.”

Hundreds of Amazon drivers in NYC join the Teamsters union

Hundreds of Amazon drivers in New York City have joined the Teamsters union in the hope of obtaining better pay and working conditions. The union says a majority of drivers at each of three delivery service partners (DSPs) working out of a Queens warehouse have signed authorization cards.

According to a Teamsters press release, the drivers have been organizing for a year to secure fair pay, consistent schedules, reasonable workloads and proper pay maintained trucks. They walked off the job last December as part of a nationwide protest against Amazon’s alleged unfair labor practices and union-busting efforts.

At least on paper, joining the union should give the drivers more leverage as they push Amazon for better working conditions. But that doesn’t necessarily mean the company will play ball. The Amazon Labor Union, one of the first major successful organization efforts within the company in the US, has yet to secure a union contract, two years after forming. The group became a Teamsters affiliate this summer.

However, the union has found some success on behalf of Amazon workers. Last month, a regional National Labor Relations Board director determined that Amazon is a joint employer of some third-party drivers in Palmdale, California. The Teamsters hope that finding will set a precedent for the rest for DSP drivers elsewhere. The Queens drivers are the first Amazon workers to organize with the Teamsters following that decision.

Former MoviePass CEO reportedly pleads guilty to securities fraud

Mitch Lowe, one of two MoviePass leaders indicted by the Justice Department in 2022, has pleaded guilty to securities fraud charges. The former CEO admitted to conspiring to deceive the public and investors about the service’s sustainability. Variety reports that the details of Lowe’s plea agreement haven’t been made public.

Prosecutors claim Lowe knew from the start that the company’s $9.95 “unlimited” plan was a short-term gimmick to attract subscribers and inflate stock. He’s also accused of making false statements in press releases, interviews and SEC filings about MoviePass’ long-term viability.

Those statements included allegedly lying about the company’s ability to become profitable on subscription fees alone and having tech that could generate revenue from customer data. He also claimed MoviePass was profiting from multiple revenue streams despite not having any income beyond subscriptions.

Prosecutors also accused Lowe and Ted Farnsworth, former CEO of MoviePass’ parent company Helios and Matheson, of preventing subscribers from getting what was promised from the “unlimited” subscription. The company settled with the FTC in 2021 over allegations that it intentionally invalidated subscriber passwords to freeze their accounts, blocking their ability to get the movie tickets the service promised. MoviePass and its parent company declared bankruptcy in 2020.

Although no sentencing date has been set, Lowe is free on bond and has a status conference court date scheduled in Miami for March 2025. The 72-year-old former executive faces a maximum of five years in federal prison.

“Mitch is a good man who is looking to move forward with his life,” Lowe’s attorneys, Margot Moss and David Oscar Markus, said in a statement to Variety. “He has accepted responsibility for his actions in this case and will continue to try to make things right.”

Meanwhile, Farnsworth is still in custody. He was initially freed on a $1 million bond that was revoked in August 2023 after the feds accused him of misusing nearly $300,000 in company funds. Farnsworth's former boyfriend, who he met on an escort site, was paid $147,000, and received a Cadillac worth $144,000; after the pair split up, the feds say he falsely accused his ex of stealing the vehicle.

An Apple Store in Oklahoma City is close to approving an union agreement for its workers

Talks between Apple and the union for the Apple Store in Oklahoma City have produced a tentative agreement that includes new benefits and protections for its staff. The Penn Square Mall Apple Store in Oklahoma City announced they’ve reached a “tentative labor agreement” with Apple and the Communication Workers of America (CWA), according to a released statement.

Terms are still being negotiated between both parties but the benefits for the store’s employees would be significant. The three-year agreement reached between the CWA and Apple would give employees a wage increase of up to 11.5 percent. An Apple spokesperson said by email that if the contract is ratified, employees would receive a 4 percent raise in the first year of employment and 3 percent in the second and third year each “based on employee performance.”

The agreement would also offer employees guaranteed paid time off and health and other benefits, allow employees to have a say in scheduling and the establishment of a “safer and more democratic workplace” through a grievance submission process with committees overseeing safety, health and working relations. An Apple spokesperson also noted the scheduling options “were provided to all other US stores in 2022.”

The Oklahoma City Apple Store had been working to form a union since 2022, becoming the second Apple Store in the US to unionize. Employees passed a strike authorization vote in August that passed with unanimous support and started a picket in front of the store ahead of bargaining sessions in early September. Workers will vote to ratify the tentative agreement on September 22.

CWA District 6 Vice President Derrick Osobase called the agreement achievement “a historic day for our members who have now secured a contract at the world’s most profitable company.”

The Apple Store in the Towson Town Center in Towson, Maryland became the first location to unionize. Members approved the union in 2022 with the International Association of Machinists and Aerospace Workers (IAM). A store in the Cumberland Mall in Atlanta, Georgia tried to form a union in 2022 with the CWA but workers called it off accusing Apple of committing “repeated violations of the National Labor Relations Act.”
